Bez nje ne mo\u017eete legalno graditi, a gradnja bez odobrenja rezultira kaznama, zaustavljanjem radova ili \u010dak nalogom za ru\u0161enje objekta.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">\u0160to je gra\u0111evinska dozvola<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Gra\u0111evinska dozvola je upravni akt kojim nadle\u017eno upravno tijelo odobrava gradnju ili rekonstrukciju gra\u0111evine prema odobrenom glavnom projektu. To je pravna osnova za po\u010detak gra\u0111evinskih radova, ali ne predstavlja pravnu osnovu za ulazak u posjed nekretnine niti utje\u010de na vlasni\u0161tvo.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Propisana je <\/span><a href=\"https:\/\/www.zakon.hr\/z\/690\/zakon-o-gradnji\"><span style=\"font-weight: 400;\">Zakonom o gradnji<\/span><\/a><span style=\"font-weight: 400;\"> i izdaje se nakon provjere jesu li ispunjeni svi uvjeti za sigurnu i zakonitu gradnju. Dozvolu izdaje ured za graditeljstvo i prostorno ure\u0111enje nadle\u017ean prema lokaciji na kojoj se planira gradnja.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Za\u0161to je potrebna gra\u0111evinska dozvola<\/span><\/h2>\n<h3><span style=\"font-weight: 400;\">Zakonska obveza<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Gradnja bez gra\u0111evinske dozvole je protuzakonita. Investitor koji gradi bez dozvole \u010dini prekr\u0161aj koji se ka\u017enjava nov\u010danom kaznom i nalogom za zaustavljanje radova. U najgorem slu\u010daju, nadle\u017eno tijelo mo\u017ee naredi ru\u0161enje nelegalno izgra\u0111enog objekta.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Dokaz uskla\u0111enosti s propisima<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Gra\u0111evinska dozvola potvr\u0111uje da je projekt u skladu s:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Prostornim planom podru\u010dja<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Gra\u0111evinskim propisima<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Tehni\u010dkim i sigurnosnim standardima<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Posebnim uvjetima javnopravnih tijela (HEP, vodovod, ceste, za\u0161tita okoli\u0161a)<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-weight: 400;\">Preduvjet za uporabnu dozvolu<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Nakon zavr\u0161etka gradnje, nekretninu ne mo\u017eete koristiti bez uporabne dozvole. Uporabna dozvola se izdaje tek nakon \u0161to gra\u0111evinska inspekcija utvrdi da je objekt izgra\u0111en u skladu s gra\u0111evinskom dozvolom i odobrenim glavnim projektom.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Bez uporabne dozvole ne mo\u017eete:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Priklju\u010diti objekt na struju, vodu, plin<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Uknji\u017eiti nekretninu u zemlji\u0161ne knjige<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Prodati ili izdavati nekretninu<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Dobiti odobrenje za obavljanje djelatnosti u objektu<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-weight: 400;\">Za\u0161tita kupaca nekretnina<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Ako kupujete nekretninu u gradnji, postojanje gra\u0111evinske dozvole jam\u010di da gradnja te\u010de legalno. Kupnja nekretnine bez gra\u0111evinske dozvole zna\u010di da nemate garanciju da \u0107e objekt uop\u0107e biti dovr\u0161en ili da \u0107e dobiti uporabnu dozvolu.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Za kakve gradnje je i nije potrebna gra\u0111evinska dozvola<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Zakon o gradnji propisuje da za jednostavne i druge gra\u0111evine i radove nije potrebno ishoditi gra\u0111evinsku dozvolu. Gradnji se mo\u017ee pristupiti bez dozvole i bez glavnog projekta.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Primjeri jednostavnih gra\u0111evina i radova:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Cisterne<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Vrtne sjenice<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Terase<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ograde standardne visine<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Staze i prilazi<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Manje poljoprivredne gra\u0111evine<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Graditi bez gra\u0111evinske dozvole, ali uz glavni projekt, mogu se:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Pomo\u0107ne zgrade do 50 m\u00b2<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Bazeni<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Sun\u010dani kolektori<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ograde visine ve\u0107e od 2,2 m<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ogradni zidovi visine ve\u0107e od 1,6 m<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Dje\u010dja igrali\u0161ta unutar parka<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Za ove gra\u0111evine potrebno je ishoditi glavne projekte, ali ne i formalnu gra\u0111evinsku dozvolu.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Gra\u0111evinska dozvola potrebna je za:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Gradnju novih gra\u0111evina:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Stambene zgrade (obiteljske ku\u0107e, vi\u0161estambene zgrade)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Poslovne zgrade (uredi, trgovine, hoteli)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Industrijske hale<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Poljoprivredne gra\u0111evine ve\u0107e od odre\u0111ene povr\u0161ine<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Rekonstrukciju postoje\u0107ih gra\u0111evina:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Dogradnja ili nadogradnja<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Promjena namjene prostora (npr. pretvaranje podruma u stan)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Gra\u0111evinski radovi koji utje\u010du na statiku ili nosivost konstrukcije<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Ostale zahvate:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Postavljanje privremenih objekata koji ostaju du\u017ee od 2 godine<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Gra\u0111enje pristupnih putova i parkirali\u0161ta<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Infrastrukturni radovi (vodovod, kanalizacija)<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-weight: 400;\">Tko mo\u017ee zatra\u017eiti gra\u0111evinsku dozvolu<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Gra\u0111evinsku dozvolu mo\u017ee zatra\u017eiti svaka osoba koja ima pravni interes za gradnju na odre\u0111enoj lokaciji. To ne zna\u010di nu\u017eno da morate biti vlasnik zemlji\u0161ta.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Zahtjev mo\u017ee podnijeti:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Vlasnik nekretnine<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Osoba s pravom gra\u0111enja na tu\u0111em zemlji\u0161tu<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Osoba s ugovorom o zakupu ili pravu slu\u017enosti<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Investitor koji ima pisanu suglasnost vlasnika zemlji\u0161ta<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Gra\u0111evinska dozvola ne utje\u010de na vlasni\u010dke odnose. Za njeno izdavanje dovoljno je dokazati pravni interes, a sam akt izdavanja dozvole ne daje pravo ulaska u posjed nekretnine.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Kako se izdaje gra\u0111evinska dozvola<\/span><\/h2>\n<h3><span style=\"font-weight: 400;\">1. Priprema dokumentacije<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Prije podno\u0161enja zahtjeva morate pripremiti:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Glavni projekt &#8211; izra\u0111uje ga ovla\u0161teni projektant (arhitekt, gra\u0111evinski in\u017eenjer). Glavni projekt sadr\u017ei:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Arhitektonski projekt<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Gra\u0111evinski projekt<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Elektrotehni\u010dki projekt (ako je primjenjivo)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Strojarski projekt (ako je primjenjivo)<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Posebni uvjeti &#8211; pribavljaju se od javnopravnih tijela poput HEP-a, vodovoda, uprave cesta, za\u0161tite okoli\u0161a i drugih tijela ovisno o vrsti gra\u0111evine.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Potvrde glavnog projekta &#8211; projektant mora ovjeriti projekt i potvrditi da je izra\u0111en u skladu s propisima.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">2. Podno\u0161enje zahtjeva<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Zahtjev za izdavanje gra\u0111evinske dozvole podnosi se elektroni\u010dki putem sustava eDozvola na adresi<\/span><a href=\"https:\/\/dozvola.mgipu.hr\"> <span style=\"font-weight: 400;\">https:\/\/dozvola.mgipu.hr<\/span><\/a><span style=\"font-weight: 400;\"> ili u papirnatom obliku u nadle\u017enom uredu za graditeljstvo i prostorno ure\u0111enje.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Sustav eDozvola omogu\u0107ava:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Elektroni\u010dko ispunjavanje svih podataka<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Dodavanje priloga i projekata<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Pra\u0107enje statusa zahtjeva u realnom vremenu<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Komunikaciju s nadle\u017enim tijelom<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-weight: 400;\">3. Provjera dokumentacije<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Nadle\u017eno upravno tijelo provjerava:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Jesu li prilo\u017eeni svi propisani dokumenti<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Jesu li utvr\u0111eni posebni uvjeti i uvjeti priklju\u010denja<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Je li projekt izra\u0111en u skladu s prostornim planom<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Je li projekt izradila ovla\u0161tena osoba<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Je li projekt pravilno ozna\u010den i za\u0161ti\u0107en od neovla\u0161tenih izmjena<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-weight: 400;\">4. Izdavanje dozvole<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Ako su svi uvjeti ispunjeni, nadle\u017eno tijelo izdaje rje\u0161enje o gra\u0111evinskoj dozvoli. Dozvola postaje pravomo\u0107na nakon isteka roka za \u017ealbu (15 dana) ako nema prigovora.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Koliko gra\u0111evinska dozvola vrijedi<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Gra\u0111evinska dozvola prestaje va\u017eiti ako investitor ne pristupi gra\u0111enju u roku od tri godine od dana pravomo\u0107nosti dozvole.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Va\u017eenje gra\u0111evinske dozvole mo\u017ee se produ\u017eiti na zahtjev investitora jednom za dodatne tri godine, pod uvjetom da se nisu promijenili uvjeti za provedbu zahvata u prostoru odre\u0111eni prostornim planom.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nakon isteka roka va\u017eenja, ako gradnja nije zapo\u010dela, potrebno je podnijeti novi zahtjev za izdavanje gra\u0111evinske dozvole.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Prijava po\u010detka gra\u0111enja<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Nakon pravomo\u0107nosti gra\u0111evinske dozvole, investitor je du\u017ean pismeno prijaviti po\u010detak ili nastavak gra\u0111enja nadle\u017enom uredu za graditeljstvo i prostorno ure\u0111enje najkasnije u roku od 8 dana prije po\u010detka ili nastavka gra\u0111enja.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Prijava se mo\u017ee izvr\u0161iti putem sustava <\/span><a href=\"https:\/\/mpgi.gov.hr\/edozvola-8144\/8144\"><span style=\"font-weight: 400;\">eDozvola<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Prije po\u010detka gra\u0111enja investitor mora:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Osigurati iskol\u010denje gra\u0111evine<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ograditi gradili\u0161te<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ozna\u010diti gradili\u0161te plo\u010dom s osnovnim podacima o gradnji<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-weight: 400;\">\u0160to se doga\u0111a nakon zavr\u0161etka gradnje<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Nakon \u0161to zavr\u0161ite gradnju u skladu s gra\u0111evinskom dozvolom, morate ishoditi uporabnu dozvolu. Uporabna dozvola izdaje se nakon tehni\u010dkog pregleda kojim se utvr\u0111uje da je gra\u0111evina izgra\u0111ena u skladu s odobrenim projektom i propisima.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Bez uporabne dozvole ne mo\u017eete zakonski koristiti objekt.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Zaklju\u010dak<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Gra\u0111evinska dozvola je obvezni korak za svaku legalnu gradnju ili rekonstrukciju. Proces mo\u017ee izgledati slo\u017een, ali uz pravilnu pripremu i stru\u010dnu pomo\u0107 ovla\u0161tenih projektanata postupak te\u010de glatko.
